BRIEF OVERVIEW OF GIVEAWAY: The “Sidewalk Sale” Giveaway (the “Giveaway”) begins on Thursday, July 18, 2024 at 10 a.m. MST and ends on Sunday, July 21, 2024 at 8:00 p.m. MST. Earn 25 points in PlayTours Sidewalk Sale Scavenger Hunt to get one (1) entry to the Giveaway.

The participation will exclusively be done by the method above mentioned. The Giveaway is limited to one entry per email address.

ELIGIBILITY: Giveaway is open only to those who sign up on the online Giveaway page and who are 18 years old as of the date of entry. The Giveaway is only open to Colorado residents and is void where prohibited by law. Employees of Cherry Creek North Business Improvement District (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

AGREEMENT TO RULES: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Cherry Creek North Business Improvement District as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state and local laws.

GIVEAWAY PERIOD: Entries will be accepted online starting on or about July 18, 2024 at 10 a.m. MST and ends on Sunday, July 21, 2024 at 8:00 p.m. MST. 

HOW TO ENTER: The Giveaway may be entered by submitting an entry using the online form provided on the PlayTours website. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You may enter once and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor.

PRIZE: (1) $500 Gift Card to a Cherry Creek North business of the winner's choice.

ODDS: The odds of winning depend on the number of eligible entries received in the Giveaway prior to the drawing date.

PRIZE DRAW: The draw among all the valid participations received will take place on Monday, July 22, 2024. One winner will be drawn and contacted by email. The finalists must respond before Friday, July 26, 2024 at 10 a.m. to verify their eligibility. A second draw will be done if the winner does not respond.

For the prize to be awarded, the winner must respond to the message and accept the prize to be picked up at the Cherry Creek North offices by Friday, July 26, 2024 at 10 a.m. at the latest. A picture may be requested by Sponsor for use in the media of its choice without any form of compensation.

The refusal to accept the chosen prize as is, regardless of the reason for refusing it, shall release Sponsor from any and all obligation, as well as its respective companies and divisions, affiliates as well as their respective directors, managers and employees. No compensation shall be claimable in the case of refusal, and the prize shall be cancelled.

The prize must be accepted as described in these rules & regulations and the winner may not request to substitute it for another prize or exchange in full or part for cash and/or transfer it to another person or apply it against a future or past purchase. The prize may not be substituted, transferred or redeemed for cash.

WINNER: On or about Monday, July 22, 2024, potential winner will be notified via email to obtain any additional required information or responses. Once confirmed, the potential winner will be sent prize pick-up details via email. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] a potential winner’s failure to respond to notification within five (5) business days after transmission; [2] the return of an email notification as undeliverable after three (3) attempts; [3] the return of any other notice or a prize as undeliverable; [4] a potential winner’s failure to provide Sponsor with satisfactory proof of age, identity, and residency; [5] a potential winner’s failure to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the Address associated with the winning Entry; [6] a potential winner’s failure to provide required additional information upon Sponsor’s request; [8] any other non-compliance with Rules. In the event of any prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner.

RELEASES: Entrants agree to release, defend and hold harmless Giveaway Entities as well as the employees, officers, directors and agents of each, from all claims and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons (including death) and property which may be sustained in connection with either directly or indirectly, 1) the awarding, receipt, ownership, use or misuse of the prize awarded herein; or 2) participation in the Giveaway or any prize-related activities, including but not limited to traveling to or from any prize -related activity. Sponsor is not responsible if Giveaway cannot take place or if prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Winner assumes all liability for any injury or damage caused or claimed to be caused by participation in this Giveaway or use or redemption of prize. Giveaway Entities assume no liability or responsibility in connection with the safety or performance of prize awarded hereunder nor in connection with any warranty or representation therewith.

The Sponsor reserves the right to cancel or modify the Giveaway if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Giveaway, as determined by Sponsor in its sole discretion. In such event, Sponsor will award any prize at random from among the eligible, non-suspect entries received for the Giveaway up to the time of the impairment. The Sponsor is not responsible for human errors, or any error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. Sponsor is also not responsible for any injury or damage to an entrant's or any other person's computer related to or resulting from participating in or downloading any materials in conjunction with the Giveaway.
